Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fixitify's websites, storefront audits, reports, workspaces, subscriptions and integrations (collectively, the "Service"). By creating an account, purchasing a subscription, connecting an integration or otherwise using the Service, you agree to these Terms. If you use Fixitify for an organization, you represent that you have authority to bind that organization.
1. The Service
Fixitify provides automated storefront intelligence, including representative crawling, technical and content observations, scoring, prioritization, monitoring and integration-assisted context. Findings are based on the data and pages available at the time of analysis and may involve automated inference. Fixitify is a decision-support tool, not a guarantee of search ranking, revenue, conversion, accessibility, legal compliance or error-free operation.
2. Eligibility and accounts
You must be legally capable of entering into these Terms and use the Service for lawful business purposes. You are responsible for accurate account information, safeguarding credentials and activity performed through your account. You must promptly notify us of suspected unauthorized access.
3. Authority to audit and connect stores
You may submit publicly reachable storefronts for analysis where your use is lawful. You may connect Google Search Console, Shopify or another authenticated service only when you are authorized to grant Fixitify access to the relevant property, store or account. You are responsible for ensuring that your use of data and reports complies with obligations you owe to your customers, users and third parties.
4. Google Search Console
The Google Search Console integration is optional and uses Google OAuth. By connecting it, you authorize Fixitify to access the Google data covered by the permissions shown in the authorization flow for the purpose of providing Search Console-powered Fixitify features. The current integration is designed around read-only Search Console access. Google services remain governed by Google's own terms and policies. You can disconnect the integration through Fixitify or revoke access through Google. Fixitify may suspend the integration if authorization expires, permissions change or Google limits or discontinues the relevant API.
5. Shopify
Fixitify is designed for Shopify storefront analysis but is an independent service unless expressly stated otherwise. Shopify is a third-party platform and its services remain subject to Shopify's own terms. The optional Shopify integration currently uses read-only permissions for supported merchant-authorized context and does not authorize Fixitify to make store changes. You may disconnect the integration, and uninstall events may cause Fixitify to remove the associated connection. API availability, data fields and permissions may change as Shopify changes its platform.
6. Acceptable use
You must not use the Service to violate law or third-party rights; access systems or data without authorization; evade access controls; probe private/internal network resources; introduce malicious code; interfere with service integrity; overwhelm the Service through abusive automation; scrape or reverse engineer the Service except where law expressly permits; resell or misrepresent Fixitify output as an official certification; or use the Service to facilitate fraud, abuse or unlawful surveillance. We may rate-limit, block or suspend activity reasonably believed to threaten users, third parties or the Service.
7. Your content and permissions
You retain rights in information you submit to Fixitify. You grant us the limited rights necessary to host, process, analyze and display that information to operate the Service and provide features you request. You represent that you have the rights and permissions needed to provide such information. Our handling of personal information is described in the Privacy Policy.
8. Fixitify intellectual property
The Service, software, design, trademarks, scoring systems, documentation and other Fixitify materials are owned by Fixitify or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to use the Service for your internal business purposes during your authorized use or subscription.
9. Subscriptions, billing and taxes
Paid features are billed according to the plan, price and billing period presented at purchase. Unless otherwise stated at checkout, subscriptions renew until cancelled. You authorize our payment provider to charge applicable fees and taxes. Cancellation stops future renewal but does not retroactively refund amounts already due except where required by law or expressly stated in a written refund policy or offer. We may change pricing prospectively with notice required by applicable law.
10. Third-party services
The Service may interoperate with Google, Shopify, payment processors, hosting providers and other third parties. We do not control those services and are not responsible for their availability, changes, acts or omissions. Your use of a third-party service may be subject to separate terms. Integration functionality may change when a third party changes its APIs, permissions, policies or products.
11. Beta, automated and evolving features
Some features may be labeled beta, shadow, experimental, observed, calibrating or similar. Such features may change and may have incomplete coverage. Automated scores and recommendations should be reviewed in context before you make material business or technical decisions. You remain responsible for changes made to your storefront or business based on Fixitify output.
12. Availability and changes
We aim to provide a reliable Service but do not promise uninterrupted or error-free availability. We may modify, add, remove or discontinue features; perform maintenance; or impose reasonable technical limits. Where required by law or a paid-service commitment, we will provide appropriate notice of material adverse changes.
13. Suspension and termination
You may stop using Fixitify at any time and may cancel applicable subscriptions through the available billing controls. We may suspend or terminate access for material breach, unlawful or abusive use, security risk, non-payment, or where necessary to comply with law or platform requirements. Provisions that by their nature should survive termination, including ownership, accrued payment obligations, disclaimers and liability limitations, will survive.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement where legally permitted. Audit results can contain false positives, false negatives or incomplete observations. Search engines, Shopify themes, apps, networks and third-party APIs can change independently of Fixitify.
15. Limitation of liability
To the maximum extent permitted by applicable law, Fixitify and its affiliates, officers, employees and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data arising from the Service. Where liability cannot be excluded, our aggregate liability arising from the Service will not exceed the amount you paid to Fixitify for the Service during the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold Fixitify harmless from third-party claims arising from your unlawful use of the Service, your breach of these Terms, or information or instructions you provide in violation of another person's rights.
17. Privacy and data protection
Our Privacy Policy describes our privacy practices, including our handling of Google API and Shopify integration data. Where a separate data processing agreement is legally required for a particular customer relationship, the parties may enter into an appropriate agreement.
18. Changes to these Terms
We may update these Terms to reflect changes to the Service, law, security requirements or third-party platform rules. We will post the updated Terms and revise the date above. Where required, we will provide additional notice or request renewed acceptance.
19. Governing terms and mandatory rights
These Terms do not waive consumer or data-protection rights that cannot be waived under applicable law. Any governing-law or forum rule applicable to your contractual relationship with Fixitify is subject to mandatory protections and jurisdictional rules that apply to you. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.
